For the purpose of optimization of procedures of leasing of the state parcels of land, according to part 2 of Article 233-8 of the Civil code of the Kyrgyz Republic, Articles 13, of the 17th constitutional Law of the Kyrgyz Republic "About the Cabinet of Ministers of the Kyrgyz Republic" the Cabinet of Ministers of the Kyrgyz Republic decides:
1. Bring in the order of the Government of the Kyrgyz Republic "About approval of the Regulations on procedure for provision of the parcels of land which are in state-owned property" of October 9, 2019 No. 535 the following changes:
in Regulations on the procedure for provision of the parcels of land which are in state-owned property, approved by the above-stated resolution:
- in Item 55-11 of the word "Item 55-10" shall be replaced with words "Items 55-10, 55-15";
- add with Item 55-15 of the following content:
"55-15. If the parcel of land passed into state-owned property on the bases provided by the Civil code of the Kyrgyz Republic, the Code of the Kyrgyz Republic about offenses, the Criminal code of the Kyrgyz Republic and the Code of penal procedure of the Kyrgyz Republic, it can be leased by direct transfer to person who was its user before emergence of the right of state-owned property to the parcel of land, and also to the owner of the buildings and constructions located on this parcel of land.
The asset holder signs with the lessee the lease agreement of the parcel of land on the same conditions, as the previous owner of the parcel of land.
The asset holder concludes with the owner of the building and construction which is in private property, the lease agreement of the parcel of land which conditions are determined by the agreement of the parties.".
