in Regulations on the Agency on protection and development of the competition of the Republic of Kazakhstan approved by the above-named Decree:

"52-1) issue of the conclusions of antimonopoly authority about lack of the subjects of private entrepreneurship performing production of similar goods, works, services when implementing public procurements by method from one source by the direct conclusion of the agreement in cases:

purchases of goods, services which are intellectual property items at person having exclusive rights concerning acquired goods, services;

acquisitions of goods by state body, works, services at joint-stock companies, limited liability partnerships, hundred percent of voting shares (shares in the authorized capital) which belong to the state, and the state companies concerning which it exercises control according to the legislation of the Republic of Kazakhstan on state-owned property which appropriate authority, including state body, is established by the laws of the Republic of Kazakhstan, presidential decrees of the Republic of Kazakhstan, except as specified purchases of goods, works, services at the organizations providing activities of bodies of homeland security, the electoral commissions;
