About modification of some regulations (about procedure for capture on the state content of foreigners)
The Parliament adopts this organic law.
This law partially shifts:
– parts (3) and (4) Article 13 and Article 15 of the Directive 2008/115/EC of the European parliament and Council of December 16, 2008 about general standards and procedures in state members for return illegally the staying natives of the third countries published in the Official magazine of the European Union by L 348 of December 24, 2008, CELEX: 32008L0115;
– part (1) Article 9 and part (1) Article 14 of Regulations (EU) No. 603/2013 of the European parliament and Council of June 26, 2013 about creation of the Eurodac system for comparison of fingerprints for the purpose of effective application of Regulations (EU) No. 604/2013, of the determination of the state member responsible for consideration of the application establishing criteria and mechanisms about provision of international protection given in one of state members the native of the third country or the stateless person, and concerning requests of law enforcement agencies of state members and Europol for comparison of the data "Eurodac" for the law-enforcement purposes, and also about amending Regulations (EU) No. 1077/2011 about creation of the European agency on operational management by large-scale IT systems in the field of freedom, safety and the right (processed) published in the Official magazine of the European Union by L 180 of June 29, 2013, CELEX: 32013R0603.
Art. I. – In the Law on regime of foreigners in the Republic of Moldova No. 200/2010 (Official monitor of the Republic of Moldova, 2010, Art. No. 179-181, 610), with subsequent changes, to make the following changes:
1. To add article 3 after the concept "removal" with the concept "preventive placement" of the following content:
"preventive placement – the measure for restriction of freedom of travel for a period of up to 72 hours ordered by competent authority concerning foreigners;".
