For the purpose of coordination of the organization of the narcological help to convicts and prisoners with mental and behavioural disturbances owing to the use of psychoactive agents, in organizations the Head Department of the Penitentiary, and also in connection with formation of the Narcological center of the Central hospital under Head Department of the Penitentiary organization No. 47 of the Ministry of Justice of the Kyrgyz Republic,

I order:

1. Approve the enclosed Instruction about procedure and conditions of rendering the narcological help to persons with mental and behavioural disturbances owing to the use of psychoactive agents, in organizations the Head Department of the Penitentiary of the Ministry of Justice of the Kyrgyz Republic, approved with the Ministry of Health of the Kyrgyz Republic it (is applied).

2. To the chief of Medical department Head Department of the Penitentiary to the premium colonel Muratov A. I.:

- in accordance with the established procedure to make state registration of this order in the MU of the KR;

- provide publication of this order in media;

- after official publication to notify the MU of the KR on publication source (the name of publishing house, date and No.).

3. Determine that this order becomes effective after state registration in the MU of the KR and official publication in media.

The instruction about procedure and conditions of rendering the narcological help to persons with mental and behavioural disturbances owing to the use of psychoactive agents, in organizations the Head Department of the Penitentiary

1. This Instruction determines conditions and procedure for rendering the narcological help to persons with mental and behavioural disturbances owing to the use of psychoactive agents, in organizations the Head Department of the Penitentiary.

2. In organizations of criminal executive system treatment of the convicts suffering from alcoholic and/or narcotic addiction is carried out:

a) in the Narcological Center of the Central hospital under Head Department of the Penitentiary organization No. 47 of the Ministry of Justice of the Kyrgyz Republic (further the Narcological Center):

- in department of therapy by a court decision;

- in department of detoksikatsionny and replacement therapy - based on the direction of chiefs of hospitals and MSCh of correctional facilities or employees of exchange bureaus of syringes, according to the indications approved by regulatory legal acts of the Ministry of Justice after consultation of the doctor of the Narcological Center;

- in rehabilitation department - based on selection by narcologists of patients from other departments of the Narcological Center;

b) in the Rehabilitation centers of organizations the Head Department of the Penitentiary.

3. All convicts suffering from alcoholic and narcotic addiction to which measures of medical nature are by a court decision appointed from the pre-trial detention center shall be without fail directed to hospitalization in the Narcological Center.

4. Duration of rate of stationary inspection and treatment: in department of therapy according to the court verdict shall not exceed 21 days, in rehabilitation department of the Narcological Center or in the Rehabilitation centers of organizations - 4-6 months, in department of detoksikatsionny and replacement therapy: the rate detoks-terapiidlitsya no more than 14 days, treatment duration is determined by replacement therapy until the end of imprisonment term. In exceptional cases, the patients connected with somatic pathology, the rate of detoks-therapy lasts no more than 30 days with decision making about transfer of the patient in other treatment and prevention facility (department Central Bank, antitubercular hospital, department of psychiatry, etc.).

5. Patients undergo complete inspection of mental and somatic condition in the Narcological Center, the diagnosis is specified. From laboratory researches clinical blood tests and urine are obligatory. The radiological research - is regular, biochemical analyses, the ECG and other researches - according to indications.

6. The specific choice of methods of treatment is performed by narcologists taking into account specific features of patients, the diagnosis, availability of associated diseases according to the operating regulatory legal acts of the Ministry of Health and Ministry of Justice.

7. Types of authority punishments according to the procedure and the conditions established by the criminal and executive legislation are applied to the persons which are on hospitalization in the Narcological Center, breaking the mode of stay in hospital. To persons which are for violation of the mode in the penal insulator (ShIZO) or the room of chamber type (RCT) it is not treated (except persons which are according to the Art. 12 WICK of the KR).

8. In the medical certificate constituted in case of completion of rate of hospitalization by the doctor of the Narcological Center its result is noted: the reached effect, changes which stepped in mental and somatic condition, nature of installation on refusal of alcohol intake, narcotic and other means. 9. After the conducted hospitalization course convicts are transferred to correctional facilities by the form of the mode and are on dispensary and preventive observation in medical and sanitary part / туберкулезно-легочной to hospital of organization, according to recommendations of doctors of the Narcological Center in which the term of dispensary observation of the patient, lasting no more than 6 months is also specified.

10. The chief of medical and sanitary part / туберкулезно-легочной hospitals of organization, for fixing of installation of the patient on abstention from the use of psychoactive agents, and also for elimination of asthenic, neurotic, dysphoric and other frustration, makes the offer of administration of organization on representation of convicts on court for removal of measures of medical nature, according to the medical certificate issued by the ad medical hoc commission of the Narcological Center approved by the order of the Ministry of Justice of 01.03.2006 No. 38, upon termination of the term of dispensary observation.

11. Patients of the Rehabilitation centers in all organizations the Head Department of the Penitentiary which by a court decision appoints measures of medical nature concerning alcoholic and/or narcotic addiction after passing of rate of therapy of dependences can be provided on court for removal of measures of medical nature based on the medical certificate of the ad medical hoc commission of the Narcological Center.

12. Persons dependent on alcohol and/or drugs, with the accompanying tuberculosis of easy and/or other bodies can receive treatment in the Narcological Center or the Rehabilitation center of organization only in inactive phase of disease.

13. Judgment availability about application of measures of medical nature to the patients suffering from alcoholic and narcotic addiction is not the basis for non-presentation of the convict on transfer in colony settlement, to parole, to replacement of unexpired part of punishment with softer type of punishment.

14. By consideration in court of idea of removal of measures of medical nature by the convict suffering from alcoholic and narcotic addiction, the ad medical hoc commission the chief of medical and sanitary part / туберкулезно-легочной represents hospitals of correctional facility or the doctor of medical and sanitary part / туберкулезно-легочной hospitals of correctional facility, or the narcologist.

The chief of Medical department the Head Department of the Penitentiary performs interaction and transfers data to the Republican Center of Narcology.

17. In case of recurrence of disease or in case of identification of dependent persons the chief of MSCh represents the patient on consultation of the narcologist who, if necessary, and the consent of the convict resolves issue of treatment in the Narcological Center of the Central hospital under organization No. 47 or in the Rehabilitation center of organization.

18. The complete information about possibility of continuation of participation in the program for replacement therapy in civil health care is provided to participants of the program for replacement therapy by the time of release from places of detention, also on hands the statement with indication of duration of participation it in this program, daily dosage of medicine, associated diseases is provided to the patient.

19. The Head Department of the Penitentiary by the time of release from places of detention is provided to patients of the Rehabilitation centers the complete information about possibility of continuation of passing of rehabilitation course in the civil sector - in rehabilitation department RTsN of the Ministry of Health of the Kyrgyz Republic, RTs of non-governmental and public organizations.
