About approval of the Procedure for maintaining the Unified register of storage locations

According to article 39 of the Law of Ukraine "About state regulation of production and turnover of ethyl alcohol, spirit distillates, bioethanol, alcoholic beverages, tobacco products, tobacco raw materials, the liquids used in electronic cigarettes and fuel" the Cabinet of Ministers of Ukraine decides:

1. Approve the Procedure for maintaining the Unified register of storage locations which is applied.

2. Provide to the State Tax Service the beginning of functioning of the Unified register of storage locations in 60 days from the date of entry into force of this resolution.

Procedure for maintaining the Unified register of storage locations

1. This Procedure determines the procedure of creation and maintaining the Unified register of the storage locations used for storage of ethyl alcohol, bioethanol and spirit distillates, alcoholic beverages, tobacco products, tobacco raw materials, the liquids used in electronic cigarettes.

The unified register of the storage locations (further - the Register) used for storage of ethyl alcohol, bioethanol and spirit distillates, alcoholic beverages, tobacco products, tobacco raw materials, the liquids used in electronic cigarettes - the component of the GNS information and communication system containing list of storage locations of ethyl alcohol, bioethanol and spirit distillates, alcoholic beverages, tobacco products, tobacco raw materials, the liquids used in electronic cigarettes (further - the storage location), with indication of the data determined by the Law of Ukraine "About state regulation of production and turnover of ethyl alcohol, spirit distillates, bioethanol, alcoholic beverages, tobacco products, tobacco raw materials, the liquids used in electronic cigarettes and fuel" on the location of storage locations and about applicants.

2. In this Procedure terms are used in the value given in the Law of Ukraine "About state regulation of production and turnover of ethyl alcohol, spirit distillates, bioethanol, alcoholic beverages, tobacco products, tobacco raw materials, the liquids used in electronic cigarettes and fuel" (further - the Law) and the Law of Ukraine "About public electronic registers".

3. The register is created and kept electronically in state language.

4. Entering of storage locations into the Register is performed by the subjects of managing determined by part one of article 39 of the Law, way of submission of the corresponding statement.

5. Creator of register information of the Register is person who submitted the application for entering of storage locations into the Register and for modification of the data containing in the Register (further - the applicant), and also officials of the device GNS and its territorial authorities.

6. The statement for entering of the storage location into the Register, for modification of the data containing in the Register moves the applicant in paper or electronic form according to the procedure, determined by article 42 of the Tax Code of Ukraine, in the GNS relevant organ determined in Item 7 of this Procedure.

Copies of the documents determined by parts eleven, the fourteenth article 39 of the Law are enclosed to the application.

7. Data on storage locations are entered in the Register by the official who is determined by the public registrar (further - the official):

1) the device GNS - concerning storage locations of ethyl alcohol, in particular bioethanol;

2) territorial authority of GNS - concerning storage locations of spirit distillates, alcoholic beverages, tobacco raw materials, tobacco products, the liquids used in electronic cigarettes:

by results of consideration of the application about entering of storage locations into the Unified register of storage locations;

by results of consideration of the application of the applicant about modification of the data containing in the Unified register of storage locations;

by results of the made decision on exception of storage locations of the Unified register of storage locations;

based on the judgment which took legal effect.

8. The register contains the following data:

1) about the subject of managing:

for legal entities - the name, code according to EGRPOU, the location;

for physical persons entrepreneurs - surname, own name, middle name (in the presence), the location (the address of the registered/declared residence (stay) on which communication with physical person is performed - registration number of accounting card of the taxpayer or series (in the presence) and passport number of the citizen of Ukraine (for physical persons which because of the religious beliefs refuse adoption of registration number of accounting card of the taxpayer and reported about it to the relevant monitoring body and have mark in the passport), unique number of entry in the Unified state demographic register (in the presence);

for persons authorized on accounting of activities for agreements on joint activities without formation of legal entity and persons responsible for content and entering of taxes into the budget during execution of agreements, - the name of the authorized person and its code according to EGRPOU and the tax number provided to such person in case of registration of the agreement according to Item 63.6 of Article 63 and Item 64.6 of article 64 of the Tax Code of Ukraine;

for foreign subjects of economic activities name and tax number of permanent mission;

2) details (number and date) of the statement for entering of storage locations into the Register, for modification of the data containing in the Register;

3) registration license number on the right of production of alcoholic beverages (except alcoholic beverages for which production alcohol ethyl, spirit distillate is used), tobacco products, the liquids used in electronic cigarettes on the tobacco cultivation right, on the right of fermentation of tobacco raw materials, on the right of wholesale and/or retail trade by the alcoholic beverages, tobacco products, liquids used in electronic cigarettes;

4) individual number of the storage location;

5) addresses of storage locations of ethyl alcohol, spirit distillates, bioethanol, alcoholic beverages, tobacco raw materials, tobacco products, the liquids used in electronic cigarettes (the area, the area, the settlement (except Kiev and Sevastopol), the street, number of house/office; cadastral number of the parcel of land on which tobacco is grown up and is stored tobacco raw materials);
