About accounting of engineering networks

Chapter I General provisions

Article 1. Subject and scope of application

(1) This law establishes the regulatory base in the field of accounting, protection and effective use of engineering networks.

(This law regulates 2):

a) accounting of engineering networks;

b) availability of data on the engineering networks created by subjects and operators of engineering networks;

c) status of the Register of accounting of engineering networks;

d) creation and maintaining Register of accounting of engineering networks;

e) rights, obligations and owner's liability and holder Reestr of accounting of engineering networks.

(3) Provisions of this law are applied to the engineering networks which are subject to accounting in all territory of the Republic of Moldova.

Article 2. Purpose of accounting of engineering networks

Accounting of engineering networks is performed for the purpose of:

a) collection, accumulating, processing, systematization, storage, use and provision of real and high-quality data on engineering networks, conservation those zones, and also about the restrictions connected with conservation zones;

b) realization of standard contents of data on the engineering networks included in the Register of accounting of engineering networks;

c) establishments of uniform conditions for integration of data on engineering networks into the Register of accounting of engineering networks;

d) protection and effective use of engineering networks.

Article 3. Concepts

For the purposes of this law the following concepts mean:

electronic archive – the structured storage of electronic documents providing their confidentiality, irrevocability and integrity and also guaranteeing their evidential force in time;

structural elements of network – constituent parts of engineering network which serve in order that bear external and internal loadings, and also to provide proper operation of engineering network;

subject:

a) the legal entity of the public law – the body of the central or local public authority, other central administrative authority, including subordinated administrative authority, autonomous bodies of the public power which within the powers provided by the law regulate activities in the field of engineering networks and exercise supervision of compliance with law in this area;

b) the legal entity of private law – the person of law who within the powers delegated according to regulations renders public services in the field of engineering networks;

integration of data – process of entering of data on engineering networks into the Register of accounting of engineering networks which is performed by means of network services or on demand and includes collection, processing, systematization, storage and updating of space and descriptive data on engineering networks for ensuring availability and accuracy of the data necessary for effective management of engineering networks;

the operator of engineering networks – any person who has engineering networks in maintaining or bears responsibility for their operation, servicing, upgrade, including technical retrofitting and development;

The register of accounting of engineering networks (further also the Register) – set of documentary data on the engineering networks which are stored in the information system organized according to the requirements established by the regulatory base;

engineering networks – set (underground, elevated and/or air) pipelines, installations, towers, support, channels, cables, other elements of network or the physical infrastructure connected with network which are located in certain territory and/or within constructions and which are intended for rendering services of water supply and sewerage, supply with electrical and heat energy, natural gas, rendering services of electronic communications, services in hydromelioration;

Article 4. Availability of data

Article 5. The engineering networks which are subject to accounting

(1) engineering networks, conservation zones of those and the prohibitions/restriction connected with conservation zones Are subject to accounting.

(2) the following engineering networks Are subject to accounting:

a) power networks;

b) networks of natural gas;

c) networks of water supply systems and sewerage;

d) networks of stormwater drainage system;

e) thermal networks;

f) networks of electronic communications;

g) networks of hydromeliorative systems.

Chapter II of Function of authorities, subjects and operators of engineering networks

Article 6. Functions of the Government

For the purpose of implementation of accounting of the engineering Government networks:

a) approves state policy on accounting of engineering networks;

b) approves national programs, concepts and strategy for accounting of engineering networks and provides their realization;

c) approves regulations on accounting of engineering networks and provides their implementation;

d) establishes powers of subjects for the purpose of ensuring accounting of engineering networks.

Article 7. Functions of the central administrative authority in the field of geodesy, cartography, geoiformatika and remote sensing

The central administrative authority in the field of geodesy, cartography, geoinformatics and remote sensing performs the following functions:

a) develops drafts of regulations concerning accounting of engineering networks;

b) monitorirut state policy on accounting of engineering networks;

c) provides on free basis of subjects and operators of engineering networks with the cartographic data and other space data necessary for creation of data on engineering networks;

d) reports annually to the Government on the course of integration of data on engineering networks into the Register;

e) performs the functions of the owner of the state information register established by the regulatory base in the field of informatization and the state information resources;

f) coordinates activities for creation of the Register at the central level;
