About modification of some legal acts of Ukraine concerning the measures directed to recovery of the rights of the condemned persons and persons detained in connection with inadequate conditions of keeping

The Verkhovna Rada of Ukraine decides:

I. Make changes to such legal acts of Ukraine:

1. In the Penitentiary code of Ukraine (The sheet of the Verkhovna Rada of Ukraine, 2004, Art. No. 3-4, 21):

Article 8 to add 1) with part eight of the following content:

"8. The administration of organization of execution of punishments shall provide proper conditions of detention of prisoners";

Article 24 part one after the paragraph of the twelfth to add 2) with the new paragraph of the following content:

"the chairman, the vice-chairman and members of the commission on consideration of claims to inadequate conditions of keeping in organizations for pre-trial detention and organizations of execution of punishments".

With respect thereto the thirteenth and fourteenth to consider paragraphs respectively paragraphs the fourteenth and fifteenth;

Part one of Article 107 to add 3) with paragraphs the seventeenth and eighteenth the following content:

"keep in proper conditions;

address to the Commission on consideration of claims to inadequate conditions of keeping in organizations for pre-trial detention and organizations of execution of punishments concerning factual determination and/or the term of content in inadequate conditions for the purpose of updating of the violated rights and in case of disagreement with the decision of the Commission to appeal it judicially";
