About modification and amendments in the order of the Minister of national economy of the Republic of Kazakhstan of July 28, 2016 No. 345 "About approval of standard form of the agreement on equity in housing construction"

1. Bring in the order of the Minister of national economy of the Republic of Kazakhstan of July 28, 2016 No. 345 "About approval of standard form of the agreement on equity in housing construction" (it is registered in the Register of state registration of regulatory legal acts at No. 14185) the following changes and amendment:
in the Standard form of the agreement on equity in housing construction approved by the specified order:
add with Item 5-1 of the following content:
"5-1. In case of change of the actual area of the residential/non-residential premise after commissioning, the parties within thirty calendar days from the date of registration of technical data sheet if other is not established by the Agreement, pay difference on the actual area.";
state Item 8 in the following edition:
"8. The cost of 1 square meter is fixed and is not subject to increase.";
state Item 29 in the following edition:
"29. The authorized company bears responsibility for the departure from the design estimates expressed in increase in the actual area of housing put into operation in relation to provided in the Agreement more than on % 1,5.
The compensation amount the shareholder of cost of the additional area in that case cannot exceed area % 1,5 costs.".
2. To provide to committee on cases of construction and housing and communal services of the Industry ministry and construction of the Republic of Kazakhstan in the procedure established by the legislation:
1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;
2) placement of this order on Internet resource of the Industry ministry and construction of the Republic of Kazakhstan.
3. To impose control of execution of this order on the supervising vice-Minister of Industry and construction of the Republic of Kazakhstan.
