About entering of amendments and changes into the Code of civil procedure of the Republic of Armenia

Article 1. In Article 102 of the Code of civil procedure of the Republic of Armenia (dalee-Kodeks) of February 9, 2018:

To add 1) with part 9.1 following of content:

"9.1. If the requirement determined by the subitem "v" of Item 1 of part 1 of article 9 of the Law "About the State Fee", in character such is that at the time of submission of the action for declaration it is impossible to determine the amount of the state tax, then the claimant pay the amount of the state fee established by the law for submission of actions for declaration with not monetary claims. In this case, if the satisfaction of the relevant requirement results in invalidity of the contract or influences the contract price, the court considers question of collection of the additional state fee according to the contract price in court resolution".

Article 2. To add part 1 of article 126 of the Code with Items 6 and 7 of the following content:

"6) the claim formulated in the action for declaration is obviously illegal (the claim, obviously, is subject to variation irrespective of the facts which are its cornerstone);

7) the claim is made by person who obviously has no right to it.".

Article 3. To recognize part 2 of article 301 of the code invalid.

Article 4. Final part and transitional provision

1. This law becomes effective in six months after its official publication.

2. This law extends to the proceedings initiated based on the actions for declaration submitted after the introduction of this law to force.
