About introduction of amendments to the Agreement on the Eurasian Economic Union of May 29, 2014

The states the members of the Eurasian Economic Union who are hereinafter referred to as with state members, being guided by article 115 of the Agreement on the Eurasian Economic Union of May 29, 2014, agreed as follows:

Article 1

Bring in the Agreement on the Eurasian Economic Union of May 29, 2014 the following changes:

Item 5 of Article 53 to add 1) with the paragraph of the following content:

"For the purpose of establishment of similar (comparable) regulation the general principles and approaches concerning establishment in the legislation of state members of responsibility for violation of mandatory requirements to products, rules and procedures of carrying out obligatory assessment of conformity are determined by the Supreme council.";

2) the name of the Section XI to add with words ", emergency phytosanitary measures";

To add 3) with Article 59-1 of the following content:

"Article 59-1. Emergency phytosanitary measures

1. Emergency phytosanitary measures are applied to the harmful organisms which are not included in the single list of quarantine objects of the Union and representing phytosanitary risk for the period before inclusion of the corresponding harmful organisms in the specified list or before receipt of analysis result of the phytosanitary risk concerning harmful organisms confirming lack of such risk.

2. The state member has the right to enter emergency phytosanitary measures in the following cases:

1) lack of the corresponding and sufficient scientific reasons for application of phytosanitary measures or impossibility of representation of such reasons in necessary terms in case of receipt of official information from relevant international organizations, state members, and also from the third countries about the taken phytosanitary measures;

2) receipt of analysis result of the phytosanitary risk concerning harmful organisms confirming availability of such risk.
