About modification of some regulations
The Parliament adopts this organic law.
Art. I. - Article 547 of the Code of penal procedure of the Republic of Moldova No. 122/2003 (repeated publication: 2013, 699), with subsequent changes to state the official monitor of the Republic of Moldova to Art. No. 248-251, in following edition:
"Article 547. Arrest of person for the purpose of extradition
(1) After receipt of the request for extradition the Prosecutor General's Office or, depending on circumstances, the Ministry of Justice without delay takes measures according to this code to provisional attachment of person which extradition is requested. The term of content of person under provisional attachment cannot exceed 12 months from the moment of detention and before transfer of person to the requesting party.
(2) Provisional attachment of person which extradition is requested can be replaced with other measure of restraint degree of jurisdiction according to the petition of the prosecutor or on own initiative or the prosecutor in the following cases:
a) the state of health of person confirmed according to part (31) Article 195, does not allow it to be in custody;
b) person with the family has the permanent residence in the Republic of Moldova and there are no bases to consider that it will evade from the procedure of extradition.
(3) To ensuring avoidance of evasion from the procedure of extradition degree of jurisdiction or, depending on circumstances, the prosecutor can apply measures to person whose extradition is requested, stipulated in Article 178, applied as appropriate.
