About modification of some regulations (some aspects of adjacent legal professions)
The Parliament adopts this organic law.
Art. I. – In the Law on legal profession No. 1260/2002 (repeated publication: The official monitor of the Republic of Moldova, 2010, No. 159, of the Art. 582), with subsequent changes to make the following changes:
1. Add Article 14 with part (4) the following content:
"(4) the Termination of lawyer activities involves dissolution of lawyer office and/or the termination of membership in the joint lawyer bureau. Implementation of lawyer activities after its termination according to Items and), b) and d) to part is forbidden (1).".
2. Part (Article 17 to add 1) with the following offer: "The certificate of the lawyer confirms membership in the Union of lawyers.".
3. State Article 22 in the following edition:
"Article 22. Licensing
(1) the License for occupation lawyer activities is the single document confirming the status of the lawyer. The license is granted for unrestricted term.
(2) the License for occupation is granted by lawyer activities for the application submitted by the applicant to the Ministry of Justice no later than 30 days from the moment of decision by the Commission on licensing of lawyer activities. The Ministry of Justice grants the license for occupation lawyer activities within 15 days from the date of filing of application if the applicant conforms to requirements, stipulated in Article 10.
(3) the Ministry of Justice the motivated decision can suspend the procedure of licensing for occupation lawyer activities before receipt of the complete information or refuse its issue if determines that the applicant does not conform to requirements, stipulated in Article 10. The decision on refusal in licensing for occupation lawyer activities is disputed according to the procedure of administrative legal proceedings without observance of the preliminary procedure.
(4) the License for occupation is granted by lawyer activities for a fee in the amount of 450 lei, deposited to account the Ministries of Justice.".
4. Add Article 29 with parts (1-1) and (1-2) following contents:
