About modification of some regulations
The Parliament adopts this organic law.
Art. I. – In the Civil code of the Republic of Moldova No. 1107/2002 (repeated publication: The official monitor of the Republic of Moldova, 2019, Art. No. 66-75, 132), with subsequent changes to make the following changes:
1. In Article 2235 of the word "in the place of opening of inheritance." shall be replaced with words ", conducting heritable production.".
2. In Article 2403 of the word "in the place of opening of inheritance." shall be replaced with words "at the venue of heritable production.".
3. In part (Article 2541 of the word "in the place of opening of inheritance" to exclude 1).
Art. II. – In the prolog of part (1) Article 411 of the Code of civil procedure of the Republic of Moldova No. 225/2003 (repeated publication: The official monitor of the Republic of Moldova, 2018, Art. No. 285-294, 436), with subsequent changes shall be replaced with words the words "in the place of opening of inheritance" "at the venue of heritable production".
Art. III. – In the Law on the notarial procedure No. 246/2018 (Official monitor of the Republic of Moldova, 2019, Art. No. 30-37, 89), with subsequent changes, to make the following changes:
1. Items a) and b) parts (3) Article 11 to recognize invalid.
2. In Article 69:
part (to state 1) in the following edition:
"(1) For opening of heritable production specified in part (2) articles 70 of person can submit the certified application for opening of heritable production to any notary whose territory of activities is in one of administrative and territorial units of the second level of the Republic of Moldova or within autonomous territorial education Gagauzia. Execution of heritable production is included into competence of the notary informed by the first and who registered heritable case in the electronic Register of heritable cases and wills.";
