About modification of some legal acts of Ukraine concerning ensuring activities of objects of critical infrastructure during action of warlike situation
The Verkhovna Rada of Ukraine decides:
I. Make changes to such legal acts of Ukraine:
1. Article 137 of the Economic Procedure Code of Ukraine (2017, No. 48, the Art. 436) to add sheets of the Verkhovna Rada of Ukraine with parts fifteen and the sixteenth the following content:
"15. Providing the claim by suspension of action of the decisions on property compulsory acquisition during action of warlike situation made according to the Law of Ukraine "On transfer, compulsory acquisition or withdrawal of property in the conditions of legal regime of warlike or emergency state" is not allowed.
16. Temporarily, during action of warlike situation and within two years after its termination or cancellation, taking measures of providing the claim, provided by this Code is not allowed if defendant (debtor) is or economic society which corresponds in total to such criteria shall be determined:
is operator of critical infrastructure;
shares (shares, shares) of economic society were compulsorily aloof during action of warlike situation;
the state in the authorized capital of economic society directly or indirectly possesses more than 50 percent of shares (shares, shares)".
2. Article 150 of the Code of civil procedure of Ukraine (2017, No. 48, the Art. 436) to add sheets of the Verkhovna Rada of Ukraine with parts thirteen and the fourteenth the following content:
"13. Providing the claim by suspension of action of the decisions on property compulsory acquisition during action of warlike situation made according to the Law of Ukraine "on transfer, compulsory acquisition or withdrawal of property in the conditions of legal regime of warlike or emergency state" is not allowed.
