About modification in Criminal, Criminal procedural codes of Ukraine and other legal acts of Ukraine concerning introduction of institute of parole of persons from serving sentence for their direct participation in defense of the country, protection of its independence and territorial integrity
The Verkhovna Rada of Ukraine decides:
I. Make changes to such legal acts of Ukraine:
1. The criminal code of Ukraine (2001, Art. No. 25-26, 131) to add sheets of the Verkhovna Rada of Ukraine with Articles 81-1 and 336-2 of the following content:
"Article 81-1. Parole from serving sentence for passing of military service
1. During mobilization and/or action of warlike situation to persons serving sentence in the form of restriction of freedom or imprisonment for certain term, court parole can be applied to passing of military service by them under the contract.
The parole from serving sentence provided by this Article is not applied to the persons condemned for making of crimes against bases of homeland security of Ukraine, condemned for making of the premeditated murder of two or more persons or committed with special cruelty, or combined with rape or sexual violence, or especially heavy corruption criminal offenses or condemned for making of the criminal offenses provided by Articles 152-156-1, 258-258-6, part four of Article 286-1, article 348 of this Code and also to the condemned officials who according to the subitem 1 of Item 3 of the note to article 368 of this Code held especially responsible position.
In case of application of parole by court on the basis determined by this Article, such person is exempted conditional ahead of schedule from serving only of primary punishment in the form of restriction of freedom or imprisonment for certain term.
2. Parole from serving sentence under the contract can be applied to passing of military service by court if the convict showed willingness to pass military service under the contract and conforms to the requirements of passing of military service for the contract determined by article 21-5 of the Law of Ukraine "About conscription and military service".
