About modification of some regulations (The Labor code and the Code about offenses)

The Parliament adopts this organic law.

This law shifts Item 5 of Article 2 and Article 3 of the Directive of the European parliament and Council 2003/88/EC of November 4, 2003 about some aspects of the organization of working hours published in the Official magazine of the European Union by L 29/9 of November 18, 2003 and Article 6 of the Directive of the European parliament and Council (EU) 2019/1158 of June 20, 2019 about balance between professional and private life of parents and guardians and cancellation of the Directive of Council 2010/18/EC published in the Official magazine of the European Union by L 188/79 of July 12, 2019.

Art. I. – In the Labor code of the Republic of Moldova No. 154/2003 (Official monitor of the Republic of Moldova, 2003, Art. No. 159-162, 648), with subsequent changes, to make the following changes:

1. To add Article 1 after the concept "work of equal value" with the concepts "shift work" and "easy work" of the following content:

"shift work – factory job which will be organized in such procedure when one workers are replaced by others on the same workplaces according to certain operating mode, including by means of rotation and which duration can be preryvny or continuous;

easy work – work which in strength of mind of the carried-out tasks and specific conditions in which it is carried out cannot do harm to safety, health or development of physical persons aged from fifteen up to sixteen years and also does not interfere with their training and professional training;".

2. Part (Article 46 to state 3) in the following edition:

"(3) the Physical person can also sign the individual employment contract on reaching age of fifteen years from written consent of parents or his legal representatives for accomplishment of easy work. Specific conditions of easy work are established by the Government.".

3. In Article 48:

in the first offer of part (the words "shall inform" shall be replaced with words 1) "shall inform timely in writing";
