Bring in the Code of the Kyrgyz Republic about the non-tax income (Sheets of Jogorku Kenesh of the Kyrgyz Republic, 2018, Art. No. 7-8, 490) the following changes:
in Article 37:
a) state part 6 in the following edition:
"6. The amount of penalty fee is charged in the amount of, equal 0,09 of percent of the size of shortage for each day of delay, except for the penalty fee charged on the amount of the size of the penalty imposed according to the Code of the Kyrgyz Republic about offenses.";
b) add part 7 with Item 6 of the following content:
"6) in the cases provided by the Code of the Kyrgyz Republic about offenses.".
Bring in the Code of the Kyrgyz Republic about offenses (the newspaper of "Erkin-limited liability partnership" of November 16, 2021, No. 122-133) the following changes:
Article 35 to add 1) with the note of the following content:
"Note. The penalty fee is not charged on the amount of the imposed size of penalty for the offenses provided by Articles 177-180, 182-200 of this Code.";
Article 568 to state 2) in the following edition:
"Article 568. Forced execution of the resolution on imposing of penalty and collection of penalty fee
1. In case of non-execution in the time established by the law in voluntary procedure for the resolution on imposing of penalty for offense on which the penalty fee is not charged the authorized body (claimant) till the lapse of time, stipulated in Article 559th of this Code, sends the resolution on imposing of penalty to the legal executive for forced execution according to the procedure, stipulated by the legislation about enforcement proceeding.
