About modification and amendments in the Code of penal procedure of the Republic of Armenia

Article 1. State Item 3 of part 1 of Article 13 of the Code of penal procedure of the Republic of Armenia (further - the code) of June 30, 2021 in the following edition:
"3) the decision not to initiate criminal prosecution concerning person or to stop criminal prosecution concerning the person accused was made, and all opportunities for continuation of production were exhausted;".
Article 2. Regarding 3rd article 31 of the Code:
Shall be replaced with words 1) In Item 2 of the word "as a part of three judges" "the majority from total number of judges".
Shall be replaced with words 2) In Item 3 of the word "as a part of simple majority of judges" "the majority from total number of judges".
Article 3. To add Item 10 of part 2 of article 46 of the Code after the words "accelerated" with the words "or imposings of penalty from consent".
Article 4. Regarding 3rd article 108 of the Code of the word "Items 1 and 3 of part 1" shall be replaced with words "part 1".
Article 5. In article 125 of the code:
1) to state part 4 in the following edition:
"4. The pawnshop from the moment of adoption of the relevant decision by the body performing production submits the document confirming bail which is attached to production materials to three-day time. Pledge is considered applied from the moment of submission of the document certifying bail to the body performing production.";
To add 2) with part 4.1 following of content:
"4.1. Failure to carry out of the obligation provided by part 4 of this Article is the basis for de novo review of question of election concerning the person accused of measure of restraint.".
