About protection of soils and increase in their fertility

The purpose of this Law is regulation of the relations in the field of protection of soils and increase in their fertility.
The legislation on protection of soils and increase in their fertility consists of this Law and other acts of the legislation.
In this Law the following basic concepts are applied:
recultivation of lands - recovery of the destroyed soil cover, its reduction in the condition suitable for use;
the soil - the upper part of the land surface which is consisting of several layers which are created as a result of impact of natural or anthropogenous factors, having necessary properties of fertility for life of plants;
destruction of the soil - physical damage, partial or elimination of soil cover in the course of mining, carrying out exploration, geodetic, construction and other works;
degradation of soils - set of the processes leading to decrease in fertility of soils, deterioration in ekologo-meliorative condition, and also to negative changes in the quantitative and high-quality relation of the soil as a result of impact of natural or anthropogenous factors;
pollution of the soil - loss and accumulating of hazardous chemical and radioactive materials, oils, oil products and microorganisms worsening quality of the soil and exerting negative impact on the environment;
protection of soils - complex of the legal, organizational, economic and other actions directed to rational use of soils and their preserving, prevention of pollution, destruction and degradation, and also protection against natural and technogenic impacts;
quality of the soil - the properties determining fertility of the soil;
quality evaluation of soils (appraisal of quality of soils) - comparative quality evaluation and natural productive capability of the soil on 100-mark scale;
recovery of soils - the actions directed to improvement of condition, quality and increase in fertility of the soil;
fertility of the soil - the properties of the soil providing plants with nutrients, heat, moisture, air and other factors of life activity;
fertile layer of earth - the upper layer of earth with favorable properties for growth of plants;
soil erosion - process of destruction of the soil under the influence of rainfall, irrigations and winds;
soil condition - set of the indicators characterizing structure, structure and properties of the soil.
The basic principles in the field of protection of soils and increase in their fertility are:
legality;
priority of health of the person and safety of the environment;
openness and transparency;
priority of the rights and legitimate interests of land owners, land users and lessees of the parcels of land.
Object of protection of soils are fertile and pedogenic layers of soils of all categories of land fund.
Actions for protection of soils and increase in their fertility include:
implementation of the state and other programs in the field of protection of soils and increase in their fertility;
recovery contaminated, destroyed or otherwise the degrading soils;
conducting monitoring of the soil;
establishment of the corresponding obligations of land owners, land users, lessees of the parcels of land on ensuring protection of soils, their rational use and preserving fertility of soils;
use of the mechanism of interest when holding economic actions for protection of soils and to increase in their fertility;
use of the methods excluding salinization, bogging and pollution of the soil and water sources in case of production of agricultural products;
implementation of meliorative actions on the salted lands;
periodic layout of lands;
creation of protective forest plantings, prevention of migration of sand and its strengthening;
use of cost-efficient systems of agriculture proceeding from territorial conditions;
use of water saving technologies in case of irrigation of crops;
landing of long-term herbs, bushes and trees for fight against water erosion on slopes;
application of actions against wind erosion;
improvement of mechanical structure of sandy, sandy and sandy loam soils with use of the soil received when cleaning collector and drainage and irrigating networks, and also reservoirs;
application of antierosion actions on the irrigated lands according to evidence-based recommendations, observance of the modes and regulations of irrigation;
prevention of technogenic consolidation of the soil;
use of mineral, organic, organomineral, bacterial and other fertilizers, and also compost and green manure crops taking into account edaphic-climatic conditions and requirement of plants.
Actions for protection of soils and increase in their fertility can include also other actions according to the legislation.
Requirements to protection and rational use of soils when implementing town-planning or other nonagricultural activities are:
in projects of placement of objects and their constructions - prediscretion of the actions directed to observance of nature protection and health requirements and preserving fertility of soils taking into account results of soil researches;
in construction projects of objects - establishment of priority of preserving the available soils on the parcels of land;
when designing objects in the adjacent territories which are not entering the project territory - taking measures to prevention of pollution, destruction or other degradation of soils;
when designing objects - determination of actions for removal, preserving and use of fertile layer of earth;
in case of construction of designed projects - observance of requirements for protection of soils.
When implementing town-planning or other nonagricultural activities also other requirements according to the legislation on protection of soils and increase in their fertility can be established.
Financing of works on protection of soils and to increase in their fertility is performed for the account:
means of the Government budget of the Republic of Uzbekistan;
means of land owners, land users, lessees of the parcels of land, and also companies and organizations;
