About introduction of amendments to article 4 of the Law of Ukraine "About legal regime of property in the Armed Forces of Ukraine" concerning simplification of the procedure of write-off of military property
The Verkhovna Rada of Ukraine decides:
I. Article 4 of the Law of Ukraine "About legal regime of property in the Armed Forces of Ukraine" (Sheets of the Verkhovna Rada of Ukraine, 1999, No. 48, Art. 407; with the changes made by the Law of Ukraine of January 27, 2022 No. 2024-IX) to add with parts of the fifth or eleventh of the following content:
"During action of warlike situation the commander of military unit on representation to the commission for write-off of military property has the right the order to write off the property assigned to military unit irrespective of the nomenclature of services of providing (except weapon) cost for unit of military property or under one act to 100000 free minima of the income of citizens without approvals and approvals of officials of the highest levels, law enforcement agencies or special law-enforcement forming as a part of the Armed Forces of Ukraine.
During action of warlike situation the solution on need of conducting investigation of the reasons and circumstances of loss or destruction, early depreciation, over-expenditure of military property (except weapon) cost for unit of military property or under one act to 100000 free minima of the income of citizens, assigned to military unit, is accepted by the commander of this part.
The corresponding investigation is surely made in case of availability of information on loss or destruction, early depreciation, over-expenditure of military property (except weapon) owing to non-execution or improper execution by person of service duties or committing by person of offense for the purpose of establishment of fault of the I degree, the size of material damage and circumstances under which harm is done.
