About introduction of amendments to articles 193 and 195 of the Housing code of the Russian Federation

Article 1

Bring in the Housing code of the Russian Federation (The Russian Federation Code, 2005, No. 1, Art. 14; 2014, No. 30, Art. 4256; 2015, No. 27, Art. 3967; 2017, No. 1, Art. 10; No. 31, Art. 4806; 2018, No. 1, Art. 69; 2019, No. 52, Art. 7796) following changes:

1) regarding 1 Article 193:

a) in Item 3 of the word "absence at the official of the licensee, the official" shall be replaced with words "absence at the official and (or) the founder (participant) of the licensee, the official and (or) the founder (participant)";

b) state item 4 in the following edition:

"4) absence in the register of persons performing functions of sole executive body of the licensee which license is cancelled persons which were founders (participants) of the licensee which license is cancelled and the share in which authorized capital exceeded fifty percent, and also persons including which were founders (participants) of the licensee, the share in which authorized capital exceeded fifty percent on which the charter or other documents of the licensee confer responsibility for observance of requirements to ensuring proper maintenance of common property in the apartment house and to which administrative punishment in the form of disqualification, individual entrepreneurs whose license is cancelled and (or) to which administrative punishment in the form of disqualification is applied (further - the register of the disqualified persons), information on the official of the licensee, the official of the license applicant is applied, about the founder (participant) of the licensee, the founder (participant) of the license applicant. Requirements of this Item imposed to the founder (participant) of the license applicant are not applied to the public authority of the Russian Federation, public authority of the subject of the Russian Federation, local government body performing functions and powers of the founder of the licensee which license is cancelled;";

c) add with Items 6.2 and 6.3 of the following content:

"6. 2) not administrative prosecution of the licensee, license applicant for gross violation of licensed requirements within three years preceding the date of receipt of the license, date of prolongation of term of its action;

6. 3) absence in the Unified Federal Register of Bankruptcy Information of information on bankruptcy of the legal entity which performed activities for management of apartment houses and officials and (or) founders of which officials and (or) founders of the license applicant, within three years preceding date of the request for the license of such license applicant were;";

Item 3 of part 1 of Article 195 to state 2) in the following edition:

"3) the register of the disqualified persons.".

Article 2

This Federal Law becomes effective since September 1, 2024.
