About introduction of amendments to articles 5 and 7 of the Federal law "About Consumer Loan (Loan)"

Article 1

Bring in the Federal Law of December 21, 2013 No. 353-FZ "About consumer loan (loan)" (The Russian Federation Code, 2013, No. 51, Art. 6673; 2017, No. 50, Art. 7549; 2018, No. 53, Art. 8480; 2019, No. 52, Art. 7801; 2021, No. 27, Art. 5156, 5157; 2022, No. 1, Art. 13; 2023, No. 1, Art. 48, 60; No. 16, Art. 2764; No. 29, Art. 5313; No. 31, Art. 5774, 5785) following changes:

1) in Article 5:

a) state part 20 in the following edition:

"20. The amount of the payment made by the borrower under the agreement of consumer loan (loan) if it is insufficient for complete obligation fulfillment of the borrower under the agreement of consumer loan (loan), repays the debt of the borrower in the following priority:

1) debt on percent;

2) debt on principal debt;

3) the percent added for current period of payments;

4) the amount of principal debt for current period of payments;

5) penalty (penalty, penalty fee) in the amount of, determined according to part of 21 these Articles;

6) other payments, stipulated by the legislation the Russian Federation about consumer loan (loan) or the agreement of consumer loan (loan).";

b) add with part of 20.1 following contents:

"20.1. The priority of debt repayment of the borrower provided by part 20 of this Article cannot be changed by agreement parties of consumer loan (loan).";

2) in Article 7:

a) add with part of 10.1 following contents:

"10.1. The rules provided by part 10 of this Article are also applied to the credit agreement, the loan agreement which are signed with physical person for the purpose of, not connected with implementation of business activity by it, and obligations of the borrower on which are provided with mortgage.";
