Some questions of the ensuring functioning of the State register of the property damaged and destroyed as a result of the fighting, acts of terrorism, diversions caused by the armed aggression of the Russian Federation against Ukraine

According to article 14 of the Law of Ukraine "About compensation for damage and destruction of separate categories of real estate units as a result of the fighting, acts of terrorism, diversions caused by the armed aggression of the Russian Federation against Ukraine and the State register of the property damaged and destroyed as a result of the fighting, acts of terrorism, diversions caused by the armed aggression of the Russian Federation against Ukraine" (further - the Law) the Cabinet of Ministers of Ukraine decides:

1. Approve the Procedure for the maintaining the State register of the property damaged and destroyed as a result of the fighting, acts of terrorism, diversions caused by the enclosed armed aggression of the Russian Federation against Ukraine.

2. Bring in the resolution of the Cabinet of Ministers of Ukraine of March 26, 2022 No. 380 "About collection, processing and accounting of information on the damaged and destroyed real estate as a result of the fighting, acts of terrorism, diversions caused by military aggression of the Russian Federation" (The Official Bulletin of Ukraine, 2022, No. 28, the Art. 1539, No. 39, the Art. 2089, No. 65, the Art. 3922) the enclosed changes.

3. And infrastructures within one month from the date of entry into force of this resolution to provide to the ministry of development of communities, territories technical capability of electronic information exchange between the State register of the property damaged and destroyed as a result of the fighting, acts of terrorism, diversions caused by the armed aggression of the Russian Federation against Ukraine (dalee-Reestr the damaged and destroyed property), and Single state electronic system in the sphere of construction; between the Register of the damaged and destroyed property and the Single digital integrated information and analytical management system process of recovery of infrastructure.

4. To provide to the ministry of digital transformation:

1) within four months from the date of entry into force of this resolution technical capability of collection and transfer to the holder Reestra of the damaged and destroyed property of statements for compensation provision by means of the Single state web portal of electronic services (further - Diya's Portal), in particular with use of mobile application of the portal of Diya (Diya);

2) within one month from the date of entry into force of this resolution of the notification of the citizens of Ukraine who submitted information notifications before entry into force of the law about the need of submission of the additional data containing in the statement for compensation provision, determined by the subitem 4 of Item 35 of the Procedure for maintaining the State register of the property damaged and destroyed as a result of the fighting, acts of terrorism, diversions caused by the armed aggression of the Russian Federation against Ukraine, and the documents determined by part seven of article 4 of the Law;

3) opportunity to receive statements from the Register of the damaged and destroyed property concerning objects of the damaged or destroyed property concerning which the information message physical persons with use of mobile application of the portal of Diya (Diya) and legal entities with use of the Portal of Diya was submitted.

5. And infrastructures within two months from the date of entry into force of this resolution to provide to the ministry of digital transformation and the Ministry of development of communities, territories technical capability of electronic information exchange between the Single state web portal of open data and the Register of the damaged and destroyed property for promulgation of the established data sets.

6. And to the Ministry of development of communities, territories and infrastructures within one month from the date of entry into force of this resolution to provide to public service concerning geodesy, cartography and the inventory technical capability of electronic information exchange between the Register of the damaged and destroyed property and the State land cadastre.

7. And infrastructures within one month from the date of entry into force of this resolution to provide to the ministry of development of communities, territories technical capability of electronic information exchange between the State register of the corporeal rights to real estate and the Register of the damaged and destroyed property.

8. And infrastructures within one month from the date of entry into force of this resolution to provide to the ministry of cases of veterans and the Ministry of development of communities, territories technical capability of electronic information exchange between the Unified state register of veterans of war and the Register of the damaged and destroyed property.

9. And infrastructures within one month from the date of entry into force of this resolution to provide to the ministry of social policy and the Ministry of development of communities, territories technical capability of electronic information exchange between the Unified information system of the social sphere and the Register of the damaged and destroyed property.

10. And infrastructures within three months from the date of entry into force of this resolution to provide to the Ministry of Internal Affairs and the Ministry of development of communities, territories technical capability of electronic information exchange between the Unified information system of the Ministry of Internal Affairs and the Register of the damaged and destroyed property.

11. Recommend to local government bodies to provide:

1) entering into the Register of the damaged and destroyed property of data:

rather damaged and destroyed real estate units;

concerning owners of real estate;

2) the podgruzka of acts of commission inspection, technical reports and other documents confirming damage or destruction of property.

Changes which are made to the resolution of the Cabinet of Ministers of Ukraine of March 26, 2022 No. 380

1. In the name and the text of the resolution of the word "military aggression of the Russian Federation" shall be replaced with words "the armed aggression of the Russian Federation against Ukraine".

2. To state the procedure for submission of the information message about the damaged and destroyed real estate as a result of the fighting, acts of terrorism, diversions caused by military aggression of the Russian Federation approved by the specified resolution in the following edition:

"No. 380 is approved by the Resolution of the Cabinet of Ministers of Ukraine of March 26, 2022

(in edition of the Resolution of the Cabinet of Ministers of Ukraine of June 13, 2023 No. 624)
