Part the second Article 313 to state 1) in the following edition:
"2. In the presence at the condemned property or premises which are left without supervision for the period of serving of punishment by it the court resolves question of taking measures to ensuring safety of the specified property or premises according to requirements of Article 313.1 of this Code.";
Chapter 39 to add 2) with Article 313.1 of the following content:
"Article 313.1. Measures for ensuring safety of property or the premises which are left without supervision on term of imprisonment by the convict
1. According to the petition of the convict the court takes out determination or the resolution on taking measures to ensuring safety of property or the premises which are left without supervision on term of imprisonment by the convict in the presence of at the same time following conditions:
1) absence at the convict of opportunity to independently ensure by stipulated by the legislation methods of the Russian Federation safety of the specified property or premises;
2) lack of data that the convict independently takes sufficient measures for ensuring safety of the specified property or premises;
3) lack of data that members of the family of the convict or other persons, the Universes to the specified premises on legal causes live in the specified premises.
