About modification and amendments in the Civil code of the Republic of Armenia

Article 1. In the second paragraph of part 1 of Article 296 of the Civil code of the Republic of Armenia of May 5, 1998 (further – the Code) the words "3 and 4" shall be replaced with words "3-4".

Article 2. To state article 443 of the Code in the following edition:

"Article 443. General terms of the agreement

1. The agreement can provide that its separate conditions are determined to the developed for the corresponding agreement types or this agreement and available parties by method, including under general conditions, published on electronic platforms or become available to the parties otherwise.

2. General terms of the agreement are considered as integral part of the agreement and are applied to the legal relationship which arose between the parties if in case of the conclusion of the agreement access with the concluding his face with its general terms fully and available method and consents in connection with them is provided.

3. In case of the conclusion of the agreement by electronic method, in addition to the conditions established by part 2 of this Article giving by person who signed the agreement, consent to general terms of the agreement by implementation of the specific action directed to it shall be provided.

4. In cases when in the agreement there is no reference to its general terms, such conditions are applied to the relations of the parties performing business activity as business customs if they conform to requirements, stipulated in Clause 7 and part 6 of article 437 of this Code.

5. The rules established by this Article are applied to separate agreement types if other is not established by rules of this Code concerning these agreement types.

6. More strict conditions of reality of general terms of the agreement can be established by the law and other regulatory legal acts.".
