About modification of some legal acts of Ukraine concerning protection of the rights of labor migrants and fight against fraud in employment abroad

The Verkhovna Rada of Ukraine decides:

I. Make changes to the following legal acts of Ukraine:

1. In the Code of Ukraine About administrative offenses (The sheet of the Supreme Council of USSR, 1984, appendix to No. 51, the Art. 1122):

Chapter 12 to add 1) with Article 166-28 of the following content:

"Article 166-28. Violation of requirements of the legislation in the field of provision of services on mediation in employment

Implementation by the subject of managing of activities for provision of services on mediation in employment abroad without inclusion in the list of the subjects of managing providing services in mediation in employment abroad according to the Law of Ukraine "About employment of the population" -

attracts imposing of penalty on officials of the legal entity and physical persons - entrepreneurs from seven thousand to eight thousand free minima of the income of citizens.

Making of violation, repeated within the year, provided by part one of this Article for which person was already subjected to administrative punishment, -

attracts imposing of penalty on officials of the legal entity and physical persons - entrepreneurs from eight thousand to ten thousand free minima of the income of citizens.

Collection from citizens of any fees, commission charges, remunerations, other payment types of services in mediation in employment in Ukraine or abroad -

attracts imposing of penalty on officials of the legal entity and physical persons - entrepreneurs from three thousand five hundred to four thousand free minima of the income of citizens";

Article 221 after figures "166-27" to add 2) with figures "166-28";

3) in Item of 1 part one of Article 255 the paragraph "the central executive body realizing state policy in the field of supervision and control of compliance with law about work (parts one - the fourth, seventh articles 41, of article 41-1-41-3, 173-5, 188-1)" to state in the following edition:
