About modification and amendments in the Law "About Power"

Article 1. In article 4 of the Law of March 7, 2001 No. ZR-148 "About power" (further – the Law):

Item 20 to state 1) in the following edition:

"20) the balancing electric power – difference of direct agreements of the electrical energy and quantities of the electrical energy sold and purchased in the markets "in day ahead" in real time, from quantities of the electrical energy which is actually delivered and received (including imported and exported or reflected by transit) for the same settlement period which is determined according to the procedure, established by rules of the market;";

To add 2) with Item 20.1 of the following content:

"20. 1) service in balancing – the service rendered according to the procedure, established by rules of the market, for the purpose of production of the balancing electrical energy;";

Item 25 after the words "acknowledged consumer" to add 3) with words "(subconsumer) with features, statutory rules of the market".

Article 2. To add article 17 of the Law with the Item "l" of the following content:

"t) grant the right and the obligation on rendering service in balancing to person having the license for production of electrical energy which based on the positive conclusion of the operator of electric utility system has opportunity to render services in balancing in the electrical power market.".

Article 3. In article 35 of the Law:

Part 1 after the word "this" to add 1) with the words "or satisfactions of own requirement";

To add 2) with parts 1.4 and 1.5 of the following content:

"1.4. to the person having the license for production, who acquired the right to rendering service in balancing the right and the obligation on rendering service in balancing in the wholesale electrical power market with the following functions is granted:
