About modification of some regulations
Art. I. - In the Law on the status of the military personnel No. 162/2005 (Official monitor of the Republic of Moldova, 2005, Art. No. 129-131, 618), with subsequent changes, to make the following changes:
1. Parts (11) - (13) Article 35 to recognize invalid.
2. Add Chapter IV with Article 35-1 of the following content:
"Article 35-1. Expense recovery for education/training
(1) In case of dismissal from military service under the contract in the cases provided by Items f), j), k) m) and o) parts (3) Articles 35, the military personnel who after the end of training and rates of basic professional training served on military service less than five years refund expenses on education/training irrespective of source of their financing in the amount of, calculated by division of the amount of the corresponding expenses on the period of execution of military service after the end of training.
(2) In case of dismissal from military service under the contract in the cases provided by Items e), f), j), k), m) and o) parts (3) Articles 35, the military personnel who after the termination of educational institutions of the sphere of military science or from the date of completion of advanced training in other forms lasting more than 60 days organized in the country or abroad irrespective of financing source, except for receipts of education/training at own expense, did not serve on military service during term from one to five years (depending on the term of training it is pro rata to the number of days of continuous professional preparation / advanced training), refund expenses on education/training in the amount of, calculated by division of the amount of the corresponding expenses for stay on military service, according to the procedure, established by the Government.
(3) the Military personnel expelled from educational institutions for educational debts for misconduct or for refusal of education continuation, except for education at own expense, refunds expenses on education/training in full according to the procedure, established by the Ministry of Defence.
