About modification and amendments in the Constitutional law "Judicial Code of the Republic of Armenia"

Article 1. In article 144 of the Constitutional law of February 7, 2018 No. ZR-95 "The judicial code of the Republic of Armenia" (further – the Law):

1) from Item of 1 part of 1 word", except for the disciplinary production initiated apropos" to exclude stipulated in Item 4 parts 1 of article 146 of this Code;

To add 2) with part 1.1 following of content:

"1.1. Terms, stipulated in Item 1 parts of 1 this Article, do not extend to the disciplinary productions initiated apropos, stipulated in Item 4 parts 1 of article 146 of this Code. If violation of regulation of substantive or procedural law on intention or rough negligence when implementing justice or other powers provided by the law as court was revealed by results of studying of the act of the European Court of Human Rights stating violation of the international obligations assumed by the Republic of Armenia in the field of human rights protection, then disciplinary production based on this violation cannot be initiated if after entry into force of the act of the European Court of Human Rights there passed 15 years.".

Article 2. In item 4 of part 1 of article 146 of the Law of the word "international court or other international instance with participation of the Republic of Armenia" shall be replaced with words "European Court of Human Rights".

Article 3. Final part and transitional provision

1. This Law becomes effective for the tenth day after its official publication.
