About modification of the Order of the Government of the Russian Federation of October 7, 2017 No. 1231

1. Approve the enclosed changes which are made to the order of the Government of the Russian Federation of October 7, 2017 No. 1231 "About the public company "Fund of Protection of the Rights of Citizens — Participants of Shared-equity Construction" (The Russian Federation Code, 2017, No. 42, Art. 6169; 2020, No. 43, Art. 6799; 2021, No. 24, Art. 4510; No. 35, Art. 6297).

2. Determine that provisions of the charter of the public company "Fund of Development of the Territories" and the Regulations on the supervisory board of the public company "Fund of Development of the Territories" approved by the order of the Government of the Russian Federation of October 7, 2017 No. 1231 "About the public company "Fund of Protection of the Rights of Citizens — Participants of Shared-equity Construction" (in edition of this resolution), are applied taking into account provisions of article 23 of the Federal law "About Introduction of Amendments to the Federal Law "About the Public Company on Protection of the Rights of Citizens — Participants of Shared-equity Construction in Case of Insolvency (Bankruptcy) of Builders and About Modification of Separate Legal Acts of the Russian Federation" and Separate Legal Acts of the Russian Federation".

3. This resolution becomes effective from the date of its official publication.

Changes which are made to the Order of the Government of the Russian Federation of October 7, 2017 No. 1231

1. In the name of the word "Fund of Protection of the Rights of Citizens — Participants of Shared-equity Construction" shall be replaced with words "Fund of development of the territories".

2. In word preamble "According to the Federal Law "About the Public Company on Protection of the Rights of Citizens — Participants of Shared-equity Construction in case of Insolvency (Bankruptcy) of Builders and about Modification of Separate Legal Acts of the Russian Federation" to exclude.

3. In Item 2:

a) in the paragraph the second the words "Fund of Protection of the Rights of Citizens — Participants of Shared-equity Construction" shall be replaced with words "Fund of development of the territories";

b) third to declare the paragraph invalid;

c) in paragraph four of the word "Fund of Protection of the Rights of Citizens — Participants of Shared-equity Construction" shall be replaced with words "Fund of development of the territories".

4. To state the regulations on the supervisory board of the public company "Fund of Protection of the Rights of Citizens — Participants of Shared-equity Construction" approved by the specified resolution in the following edition:

Regulations on the supervisory board of the public company "Fund of Development of the Territories"

I. General provisions

1. This Provision establishes procedure for forming of the supervisory board of the public company "Fund of Development of the Territories" (further - Fund), and also operating procedure and interactions of the supervisory board of Fund with other bodies of Fund.

2. The supervisory board of Fund exercises control of activities of Fund, including of execution of the decisions made by governing bodies of Fund, use of fund, observance of provisions of the legislation of the Russian Federation by it and the fund charter.

3. Activities of the supervisory board of Fund are performed according to the Federal Law "About the Public Company "Fund of Development of the Territories" and about Modification of Separate Legal Acts of the Russian Federation", other Federal Laws, the fund charter and this Provision.

The supervisory board of Fund performs the activities on a voluntary basis.

4. Powers of the supervisory board of Fund, stipulated by the legislation the Russian Federation, cannot be submitted executive bodies of Fund - to board of Fund and the CEO of Fund.

7. The structure of the committees and commissions created within powers by the supervisory board of Fund joins employees of Fund and external experts. The committee or the commission are headed by the member of the supervisory board of Fund. Committees and the commissions of the supervisory board of Fund perform the activities based on the provisions approved by the supervisory board of Fund.

II. Structure of the supervisory board of Fund

8. The quantitative structure of the supervisory board of Fund shall not exceed 9 members.

9. The structure of the supervisory board of Fund, including the chairman of the supervisory board Fonda, affirms the Government of the Russian Federation according to the offer of the Ministry of Construction and Housing and Communal Services of the Russian Federation for a period of 3 years. The members of the supervisory board of Fund who are persons replacing the state positions of the Russian Federation, the state positions of subjects of the Russian Federation or persons replacing positions of the public civil service perform the activities based on the decision of the Government of the Russian Federation on statement of structure of the supervisory board of Fund.

13. Members of the supervisory board of Fund begin to perform powers from the date of their inclusion in structure of the supervisory board of Fund.

14. Powers of the chairman and other members of the supervisory board of Fund can be stopped ahead of schedule according to the decision of the Government of the Russian Federation.

III. Rights, obligations and responsibility of members of the supervisory board of Fund

15. Members of the supervisory board of Fund have the right:

a) obtain information on activities of Fund, and also get acquainted with documents of financial accounting and other documents of Fund;

b) require compensation by persons specified in Article 53.1 of the Civil code of the Russian Federation, the losses caused to Fund;
