About modification of some regulations
The Parliament adopts this organic law.
Art. I. - Item i) article 11 of the Executive code of the Republic of Moldova No. 443/2004 (repeated publication: The official monitor of the Republic of Moldova, 2010, Art. No. 214-220, 704), with subsequent changes, after words of "Disciplinary board of National union of legal executives" to add with words ", the Commissions on authorization and discipline of the authorized managing directors".
Art. II. - In Article 67 of the Insolvency act No. 149/2012 (Official monitor of the Republic of Moldova, 2012, Art. No. 193-197, 663), with subsequent changes, to make the following changes:
in part (the words "the degree of jurisdiction after the prevention imposes on it judicial penalty which size cannot exceed 30000 lei, paid to the government budget, and/or takes other measures according to the Law on the authorized managing directors No. 161/2014." shall be replaced with words 1) "the degree of jurisdiction imposes as the procedural sanction judicial penalty in the amount up to 500 conventional units according to the size established by the Code of civil procedure for conventional unit.";
add Article with part (3) the following content:
"(3) If the degree of jurisdiction considering insolvency matter states availability of act which can represent the disciplinary violation made by the managing directors/liquidator, provided by the Law on the authorized managing directors No. 161/2014, it notifies on it the Commission on authorization and discipline of the authorized managing directors within no more than 30 days from the date of establishment.".
Art. III. - In the Law on the authorized managing directors No. 161/2014 (Official monitor of the Republic of Moldova, 2014, Art. No. 293-296, 605), with subsequent changes, to make the following changes:
1. In all text of the law of the word "Commission on Deontology and Professional Training" shall be replaced with words "The commission on professional training" in the corresponding case.
