About introduction of amendments to article 38.1 of the Federal law "About Finance Lease (Leasing)"

Article 1

Bring in article 38.1 of the Federal Law of October 29, 1998 No. 164-FZ "About finance lease (leasing)" (The Russian Federation Code, 1998, No. 44, Art. 5394; 2002, No. 5, Art. 376; 2022, No. 12, Art. 1783) following changes:

The word "Provisions" shall be replaced with words 1) "1. Provisions";

To add 2) with Items 2 - 7 following contents:

"2. If the agreement of leasing signed between the lessor and the leasing recipient who are residents of the Russian Federation till February 24, 2022 contains condition about determination of the size of leasing payments depending on change of key interest rate of the Bank of Russia or other variable (numerical value) which is regularly placed in public sources of information, or increase in expenses on interest payment on the loan (loan) granted to the lessor for acquisition of subject of leasing or establishes possibility of change of the size of leasing payments by the lessor unilaterally in case of approach of the specified circumstances, then in case of increase in the size of leasing payments on such bases during the period from February 24 to December 31, 2022 the leasing recipient has the right to address once the lessor with the requirement about transfer to it in property of subject of leasing completely or its parts without charge of penalties (penalties, penalty fee) and applications of other measures of responsibility, except as specified, if the agreement of leasing does not provide transition of subject of leasing to property of the leasing recipient after the term of the specified agreement of leasing.
