About entering of amendments into the Code of penal procedure of the Republic of Armenia

Article 1. To add the code of penal procedure of the Republic of Armenia of July 1, 1998 (further - the Code) with Article 20.1 of the following content:

"Article 20.1. Prohibition of illegal behavior

1. Persons participating in criminal trial shall exercise the right and fulfill the duties honesty.

2. Abuse of the rights which does harm to interests of other persons or justice is forbidden.

3. The judicial sanction proportional to his behavior can be applied to the person which allowed abuse of the rights or who maliciously did not fulfill duties in the cases provided by this Code if its non-use can threaten normal course of production.

4. In case of malicious non-execution by the person accused of the obligations the measure of restraint can be applied to it, or the applied measure of restraint can be replaced with other, more suitable measure of restraint.".

Article 2. To add part 1 of Article 314.1 with item 4 of the following content:

"4) restriction of implementation of the right.".

Article 3. Add the code with Article 314.4 of the following content:

"Article 314.4. Restriction of implementation of the right

1. Restriction of implementation of the right is establishment by the judgment of temporary or quantitative conditions of implementation of procedural law of person in case of its periodic abuse of them.

2. The judicial sanction provided this Articles can be applied only in case of periodic abuse of the following rights:

1) initiation of the petition;

2) statement of branch;

3) representation of materials for appendix to criminal case and researches;

4) acquaintance with the criminal case file and the statement of data from them in any amount;

5) performance with the speech;

6) refusal of the defender;

7) termination of powers of the defender.
