About introduction of amendments to the Law of Ukraine "About public purchases" and other laws of Ukraine concerning purchases of medicines under agreements of the managed access
The Verkhovna Rada of Ukraine decides:
I. "About public purchases" (Sheets of the Verkhovna Rada of Ukraine, 2019, No. 45, of Art. 289 with subsequent changes) to add the Section X "Final and transitional provisions" of the Law of Ukraine with Item 3-4 of the following content:
"3-4. Determine that till December 31, 2023 operation of this Law does not extend to cases if subject of purchase are the original (innovative) medicines which are subject to agreement purchase of the managed access which consist according to the law the central executive body which provides forming and realizes state policy in the field of health care, or according to its order person authorized on implementation of purchases in the field of health care, with the owner of the registration certificate on original (innovative) medicine or the representative authorized by it.
Information on the international unlicensed name (in the presence), the trade name, form of release and dosage of medicine concerning which the agreement of the managed access is signed and also concerning the applicant, the authorized representative of the applicant (in the presence), the duration of the agreement of the managed access will be promulgated in electronic purchasing system within three working days from the date of the conclusion of the relevant agreement of the managed access. The annual report on results of monitoring of the agreement of the managed access will be promulgated in electronic purchasing system within three working days from the date of carrying out monitoring.
Value of the term "original (innovative) medicines" is determined by the legislation".
II. Final provisions
1. This Law becomes effective from the date of, its publication following behind day.
