About modification of some regulations

The Parliament adopts this organic law.

Art. I. - In article 15 of the Law on the National commission on the financial market No. 192/1998 (repeated publication: The official monitor of the Republic of Moldova, 2007, No. 117-126BIS), with subsequent changes to make the following changes:

part (to add 1) with Items g) and h) the following content:

"g) establishments of improper execution or non-execution of the obligations, prerogatives or powers;

h) the inadequate activities established as a result of the parliamentary control exercised according to the law.";

add Article with parts (1-1) and (1-2) following contents:

"(1-1) In case of establishment of the bases for response in connection with improper execution or non-execution of service duties, prerogatives or powers or owing to assessment of activities of body as inadequate the profile parliamentary commission objectively it is also transparent analyzes institutional management, the decisions made by body, activities reports of body, audit reports, claims, claims, petitions, the individual purposes of activities and performance indicators of the estimated person, other relevant data and data collected and provided to the commission. On the basis of the carried-out analysis the profile parliamentary commission constitutes the report in which management skills and professional competence of the member of Administrative board, method of execution by it of the service duties and powers are estimated or, on circumstances, efficiency of activities of body is estimated. In the course of consideration of the bases for response the profile parliamentary commission can hear members of Administrative board and any employee of organization in which they work, and also to request and receive any relevant information from physical persons or legal entities. In case of establishment by the profile parliamentary commission of availability of the bases for response provided by Items g) and h) parts (1), that constitutes the motivated report with factual statement, the circumstances and conditions forming the basis for response and transfers him to the plenary session of Parliament.
