About change of the Presidential decree of the Republic of Belarus
For the purpose of enhancement of the mechanism of legal regulation of procedures of economic insolvency (bankruptcy) of agricultural organizations I decide:
1. Bring in subitem 11.4 of Item 11 of the Presidential decree of the Republic of Belarus of July 4, 2016 No. 253 "About measures for financial improvement of agricultural organizations" the following changes:
"internal" to exclude the word from part three;
the eighth after the word "sale" to add part with words "(transfer to the creditor not implemented at the biddings)";
after part nine to add the subitem with part of the following content:
"State registration concerning transferred to the creditor of the company as property complex of agricultural organization which is not implemented at the biddings is performed according to the application of the creditor submitted no later than two years from the date of its transfer based on the agreement on transfer of the company as the property complex which is not realized at the biddings, to the competitive creditor on account of repayment of debts, the document which draws up results of inventory count, the balance sheet of agricultural organization, the list of the property, including property rights which is part of the transferred company as property complex, and the transfer act.";
the tenth after words "sold" and "buyer" to add part respectively with words "(transferred to the creditor)" and "(creditor)";
after part ten to add the subitem with parts of the following content:
"In the procedure of liquidating production sale of the capital structures (buildings, constructions) belonging to the debtor, the isolated rooms, parking places, the incomplete preserved capital structures without availability of the documents certifying their state registration is allowed.
