Determine that the solutions on compliance of the industrial (industrial) park and managing company of the industrial (industrial) park to requirements to industrial (industrial) parks and managing companies of industrial (industrial) parks for the purpose of application of measures of stimulation of activities to them in the field of the industry approved by the order of the Government of the Russian Federation of August 4, 2015 No. 794 "About industrial (industrial) parks and managing companies of industrial (industrial) parks" accepted by the Ministry of Industry and Trade of the Russian Federation before entry into force of this resolution are effective before the expiration of their action.

3. Declare invalid Item of 1 changes which are made to the order of the Government of the Russian Federation of August 4, 2015 No. 794, No. 794 and recognition approved by the order of the Government of the Russian Federation of April 17, 2018 No. 458 "About modification of the order of the Government of the Russian Federation of August 4, 2015 No. 879 which voided Item 2 of the order of the Government of the Russian Federation of July 24, 2017" (The Russian Federation Code, 2018, No. 17, the Art. 2499).

1. This document establishes requirements to industrial (industrial) parks and managing companies of industrial (industrial) parks for the purpose of application of the measures of stimulation of activities in the field of the industry established by the Federal Law "About Industrial Policy in the Russian Federation", other Federal Laws, regulatory legal acts of the President of the Russian Federation, regulatory legal acts of the Government of the Russian Federation to the managing company of the industrial (industrial) park and subjects of activities in the field of the industry using the objects of industrial infrastructure which are in structure of the industrial (industrial) park.

The requirements established by the this document are applied to agro-industrial parks and managing companies of agro-industrial parks.

2. The concepts used hereunder mean the following:

"the agro-industrial park" - the industrial (industrial) park which objects of industrial infrastructure are used for creation of industrial production or upgrade of industrial production, including implementation of production, primary and (or) subsequent industrial conversion of agricultural products, raw materials and food and their realization, and also rendering services in servicing of agricultural production and conversion of agricultural products;

"the operating industrial (industrial) park" the industrial (industrial) park having residents of the industrial (industrial) park which objects of industrial infrastructure are put into operation and conform to requirements of Item 5 of this document;

"utility infrastructure" - set of the objects and engineering constructions intended for supply activity of goods and rendering services in spheres of electric utility service, gas supply and (or) heat supply, water supply, water disposal, communication to connection points (technological accession) to engineering utility power systems, gas supply and (or) heat supply, water supply, water disposal and communication of capital construction projects, providing activities of residents of the industrial (industrial) park and users of infrastructure of the industrial (industrial) park, the objects used for utilization, neutralization and burial of solid utility waste and also the objects necessary for ensuring industrial safety of the hazardous production facilities operated by residents of the industrial (industrial) park according to the Federal Law "About Industrial Safety of Hazardous Production Facilities";

"the usable space of buildings, structures of the industrial (industrial) park" - the part of buildings, the structures located in the territory of the industrial (industrial) park intended for accommodation of residents and (or) potential residents of the industrial (industrial) park and also users of infrastructure of the industrial (industrial) park. Do not enter the usable space of buildings, structures of the industrial (industrial) park the part of the square of buildings, structures of the industrial (industrial) park intended for placement of objects of utility and transport infrastructures of the industrial (industrial) park, and also the room public, utility and technical rooms;

"the usable space of the territory of the industrial (industrial) park" - the part of the territory of the industrial (industrial) park intended for accommodation of residents and (or) potential residents of the industrial (industrial) park and also users of infrastructure of the industrial (industrial) park. The part of the territory of the industrial (industrial) park intended for placement of objects of utility and transport infrastructures of the industrial (industrial) park does not enter the usable space of the territory of the industrial (industrial) park;

"the user of infrastructure of the industrial (industrial) park" - the legal entity or the individual entrepreneur who are not residents or potential residents of the industrial (industrial) park, performing activities in the territory of the industrial (industrial) park with use of objects of industrial infrastructure of the industrial (industrial) park for the purpose of ensuring activities of managing company of the industrial (industrial) park and (or) residents of the industrial (industrial) park;

"potential resident of the industrial (industrial) park" - the legal entity or the individual entrepreneur who concluded the agreement of intent or the provisional agreement of lease and (or) purchase and sale providing obligation of managing company of the industrial (industrial) park with managing company of the industrial (industrial) park to provide to the legal entity or the individual entrepreneur the parcel of land, and (or) its part, and (or) the building, and (or) structure, and (or) the part of the building and (or) structure located in the territory of the industrial (industrial) park, provided with objects of utility and transport infrastructures which list and characteristics are determined by the agreement of the parties and intention or obligation of the legal entity or individual entrepreneur to place and conduct industrial production of industrial output in the territory of the industrial (industrial) park (further respectively - the agreement of intent, the provisional agreement);

"industrial infrastructure" - the set of objects of utility and transport infrastructures of the industrial (industrial) park, building, structures located in the territory of the industrial (industrial) park necessary for implementation of activities in the field of the industry;

"resident of the industrial (industrial) park" - the legal entity or the individual entrepreneur who concluded with the managing company of the industrial (industrial) park or the organization attracted with managing company of the industrial (industrial) park on contractual basis, the lease agreement and (or) the purchase and sale agreement of objects of industrial infrastructure and (or) their parts located in the territory of the industrial (industrial) park, and (or) the parcels of land and (or) their parts which are part of the territory of the industrial (industrial) park for the purpose of conducting industrial production (further - the agreement);

"the created industrial (industrial) park" the industrial (industrial) park having potential residents of the industrial (industrial) park which objects of industrial infrastructure are at stage of construction upgrades and (or) reconstruction and conform to requirements of Item 3 of this document;

"creation and development of the industrial (industrial) park" - the activities for creation and development of the industrial (industrial) park performed in the form of the layout of the territory, architectural and construction designing, capital construction, reconstruction and (or) upgrade of objects of industrial infrastructure of the industrial (industrial) park for the purpose of accommodation of residents and (or) potential residents of the industrial (industrial) park and ensuring their activities;

"the territory of the industrial (industrial) park" set of the parcels of land which are at distance no more than 2 kilometers from each other in which borders are placed and (or) is planned to place objects of industrial infrastructure of the industrial (industrial) park;
