About modification and amendments in the order of the Minister of Finance of the Republic of Kazakhstan of November 30, 2015 No. 598 "About approval of Rules of carrying out cameral control"

1. Bring in the order of the Minister of Finance of the Republic of Kazakhstan of November 30, 2015 No. 598 "About approval of Rules of carrying out cameral control" (it is registered in the Register of state registration of regulatory legal acts at No. 12599) the following changes and amendment:

in the Rules of carrying out cameral control approved by the specified order:

"1. These rules of carrying out cameral control (further – Rules) are developed according to the subitem 9) of article 14 of the Law of the Republic of Kazakhstan "About the state audit and financial control" (further – the Law) and determine procedure for carrying out cameral control.";

"3. Other concepts used in these rules are applied in the values determined by the Budget code of the Republic of Kazakhstan, the Administrative procedural Procedure Code of the Republic of Kazakhstan, the Law and other legislation of the Republic of Kazakhstan.";

"Chapter 3. Quality control of cameral control and quality control of consideration of claims of participants of public procurements";

"22. Department of authorized body by means of the web portal exercises quality control of cameral control of public procurements and consideration of claims of participants of public procurements to the amount from 300 000 000 (three hundred million), tenge and more no later than the termination of terms, stipulated in Item 17 these rules.";

"29. By results of consideration of objection one of the following decisions is accepted:

1) about satisfaction of objection – in case of satisfaction, all questions disputed by object of the state audit;

2) about partial satisfaction of objection – in cases of partial satisfaction of the questions disputed by object of the state audit;

3) about refusal in satisfaction of objection with reasons for adoption of such decision – in cases of dissatisfaction of all questions disputed by object of the state audit according to the procedure and terms, the stipulated in Clause 58-5 Laws.

The decision by results of consideration of objection is drawn up by the conclusion by results of consideration of objection, in form according to appendix 6 to these rules.

The conclusion by results of consideration of objection automatically is registered and goes to object of the state audit by means of the web portal.";

state Item 31 in the following edition:

"31. The claim treatment procedure in case of disagreement with the decision by results of consideration of the claim and (or) the notification directed by territorial subdivision is provided by appendix 7 to these rules. In case of disagreement with the decision by results of consideration of the claim provided by the paragraph third the subitem 4) of Item 17 of these rules and (or) with the notification directed by territorial subdivision, the potential supplier who submitted the application for participation in the corresponding tender (auction) if necessary submits to department of authorized body by means of public information systems, including by means of the web portal, the claim to actions (failure to act) and acts (decisions) of territorial subdivision in form according to appendix 8 to these rules in the appeal commission under authorized body, no later than five working days from the date of receipt of the notification object of the state audit or from the date of receipt of the decision by results of consideration of the claim.

The claims which arrived after the term provided by part one of this Item are considered according to the Administrative procedural Procedure Code of the Republic of Kazakhstan.";
