About modification and amendments in the Code of penal procedure of the Republic of Armenia

Article 1. To state part 3.2 of Article 172 of the Code of penal procedure of the Republic of Armenia of July 1, 1998 (further - the Code) in the following edition:
"3.2. On the brought criminal cases the court satisfies with the motivated decision the petition of the body performing criminal prosecution for issue permission to carrying out confiscation or search for the purpose of receipt of the data which are bank secrecy, office data on the security transactions made by the Central depositary, established by the Law of the Republic of Armenia "About the security market", and also the data which are the mystery of insurance if they concern:
1) suspect;
2) person accused;
3) physical person concerning which there is reasonable assumption that between it and person specified in Item 1 or 2 of this part there is direct connection and these information about him directly concerns the act attributed to person specified in Item 1 or 2 of this part;
4) the legal entity concerning whom there is reasonable assumption that its activities completely or by the concerning part are controlled, controlled or any method actually goes person specified in Item 1 or 2 of this part, and these information about him directly concerns the act attributed to person specified in Item 1 or 2 of this part.".
Article 2. To add article 262 of the Code with part 1.1 following of content:
"1.1. If during inquiry or pretrial investigation according to the procedure, established by part 3.2 Articles 172 of this Code, the information about person who is not the participant of legal procedure was collected, then the investigator reports to him about its right to study the case papers containing such data, except as specified when in connection with them res criminal case is brought.".
