Bring in part the fourth the Civil code of the Russian Federation (The Russian Federation Code, 2006, No. 52, of the Art. 5496) change, having added with its Article 1360.1 of the following content:
"Article 1360.1. Use of the invention for production of medicine for the purpose of its export according to the international treaty of the Russian Federation
1. The government of the Russian Federation has the right in cases and on the conditions provided by the international treaty of the Russian Federation to make the decision on use of the invention for production in the territory of the Russian Federation of medicine for the purpose of its export without the consent of the patentee with the notification it on it in the shortest possible time and with payment of proportional compensation to it. The specified decision shall contain data on the medicine production volume determined by requirements of foreign state on which territory medicine is subject to export. Packaging of such medicine shall have special designation.
2. The procedure for the direction of the notification specified in Item 1 of this Article, the basis and procedure for decision making about use of the invention for production in the territory of the Russian Federation of medicine for the purpose of its export and the termination of its action, procedure for determination of effective period of the decision, and also technique of determination of the amount of compensation and procedure for its payment affirm the Government of the Russian Federation according to the international treaty of the Russian Federation.".
