About modification and amendments in the Code of civil procedure of the Republic of Armenia

Article 1. In Article 102 of the Code of civil procedure of the Republic of Armenia of February 9, 2018 (further - the Code):

1) part 2 to recognize invalid;

To add 2) with part 12 of the following content:

"12. If in proceedings on the reference according to the procedure of the simplified production the court makes the decision on its consideration according to the procedure of general claim productions, then the claimant shall pay the amount of the state tax established by the Law for submission of the action for declaration according to the procedure of general claim production. In that case the court in court resolution raises the question of collection of the additional state fee according to the size established for submission of the action for declaration according to the procedure of general claim production.".

Article 2. To add article 109 of the Code with part 7 of the following content:

"7. In case of return of the order about payment the debtor performs duty on compensation of the state fee paid by the applicant.".

Article 3. To add article 301 of the Code with part 2 following of content:

"2. In the cases provided by part of 1 this Article in the decision on consideration of the case according to the procedure of general claim production the court specifies possibility of collection of the additional state fee final court resolution.".

Article 4. To add part 2 of article 309 of the Code after the word "proofs" with words ", and also the original document, certifying payment of the state fee in the procedure and the size established by the law, or the corresponding code certifying transfer into the corresponding treasurer bill given payment and settlement the organizations or in the cases provided by the law - the petition for provision of privilege on payment of the state fee".

Article 5. To add part 1 of article 312 of the Code with Item 5 of the following content:
