Chapter 1. General provisions

Article 1. State companies

1. The companies treat state:

1) based on the right of economic maintaining;

2) based on the right of operational management (the state company).

2. Depending on type of state-owned property of the company are subdivided on:

1) the companies which are in republican property, the republican state companies;

2) the companies which are in utility property, the utility state companies.

3. The state company created by other state company is the affiliated state enterprise.

4. Excluded

5. The companies created by National Bank of the Republic of Kazakhstan are the republican state companies.

The procedure for creation, regulation and termination of activities of the companies of National Bank of the Republic of Kazakhstan is determined by this Law, taking into account the features established by regulatory legal acts of National Bank of the Republic of Kazakhstan.

Article 2. Appointment of the state companies

1. Basic purpose of activities of the state companies is the solution of the social and economic tasks determined by requirements of society and state:

1) material security of defense capability of the state and protection of interests of society;

2) production of goods (works, services) of prime necessity in those spheres and areas of social production which are not covered or insufficiently covered by private sector of economy;

3) implementation of activities in the spheres referred to the state monopoly or which are function of the state, except for control and supervising functions.
