Their parts containing drugs or psychotropic substances, precursors of drugs or psychotropic substances, plants, containing precursors of drugs or psychotropic substances, or their parts containing precursors of drugs or psychotropic substances, the fact of finding of person in condition of drug intoxication or detection in body of the person of drugs, psychotropic substances or their analogs in the absence of the sufficient data specifying the fact of their transfer to violation of provisions of the Federal Law of January 8, 1998 No. 3-FZ "About drugs and psychotropic substances" cannot form the basis for initiation of legal proceedings about the crimes provided by articles 228.1 and 228.4 of the Criminal Code of the Russian Federation regarding illegal sale of drugs, psychotropic substances or their analogs, the plants containing drugs or psychotropic substances, or.".
