About modification of some legal acts of Ukraine concerning refining of procedure for transfer to lease of water objects in complex with the parcels of land
The Verkhovna Rada of Ukraine decides:
I. Make changes to such legal acts of Ukraine:
1. In article 51 of the Water code of Ukraine (The sheet of the Verkhovna Rada of Ukraine, 1995, No. 24, the Art. 189):
speak rapidly third, the eleventh, the twelfth, fourteenth and seventeenth to state in the following edition:
"Water objects are provided in use according to the land lease agreement in the complex with the water object located on it according to the procedure determined by the land legislation of Ukraine. The right of lease of the parcel of land under water object extends to such water object";
"The standard agreement of lease of land with the water object located on it affirms as complex the Cabinet of Ministers of Ukraine.
Conditions of use of water objects, the amount of the rent and the duration of the agreement of lease are determined in the land lease agreement in complex with the water object located on it";
"For use of water object the lessee shall pay the rent for water object and the rent for the parcel of land under such water object";
"Lessees to whom water object is provided in use under lease shall give to other water users opportunity to perform special water use according to the procedure, established by this Code, except cases if such special water use makes impossible use by the lessee of water object for the needs determined in the lease agreement. Water users to whom permissions to special water use are issued have the right to dump sewage in leased water objects provided that at the same time standard rates of maximum permissible dumping of pollutants are not exceeded";
