About introduction of amendments to the Law of Ukraine "About the market of electrical energy" concerning settlement of problematic issues in the market of electrical energy

The Verkhovna Rada of Ukraine decides:

I. Bring in the Law of Ukraine "About the market of electrical energy" (Sheets of the Verkhovna Rada of Ukraine, 2017, No. 27-28, of Art. 312; 2018, No. 49, Art. 399; with the changes made by the Law of Ukraine of July 21, 2020 No. 810-IX) the following changes:

1. The fourth Article 66 to add part with paragraphs the third and fourth the following content:

"The parties of the bilateral agreement which are part of one vertically integrated subject or are affiliated among themselves, within three working days after the conclusion of the bilateral agreement inform the Regulator on the subject of the agreement, the price of electrical energy and/or procedure for its calculation (forming), amount of electrical energy and schedules of hourly amount of purchase sale of electrical energy, terms and procedure for delivery of electrical energy.

The regulator for the purpose of ensuring sufficient level of liquidity in the market of electrical energy has the right to set restrictions on monthly sales amount of electrical energy according to bilateral agreements between producers and other participants of the market of electrical energy who are part of one vertically integrated subject of managing or are affiliated among themselves. Such restriction cannot be more than 50 percent of their monthly sales amount of electrical energy".

2. To add Item 13 of the Section XVII "Final and transitional provisions" after the paragraph of the ninth with six new paragraphs of such content:

"The electrical energy which is acquired at the supplier of universal services and is consumed:

in apartment apartment houses on the technical purposes (work of the individual thermal Items, boiler rooms, elevators, pumps and castle intercoms belonging to owners of apartments of the apartment house on the right of common property) and lighting of the yards, steps and registration plates;
