About change of resolutions of Council of Ministers of the Republic of Belarus

Council of Ministers of the Republic of Belarus DECIDES:

1. Make changes to the following resolutions of Council of Ministers of the Republic of Belarus:

1.1. in Regulations on procedure, features and the bases of provision to citizens of special premises of the state housing stock in houses nursing homes for aged and disabled people, houses nursing homes for handicapped children, special houses for veterans, aged and disabled people, No. 1408 approved by the resolution of Council of Ministers of the Republic of Belarus of September 24, 2008:

in Item part one 5, Items 5-1 and 6 of the word "the age granting pension entitlement on age in accordance with general practice" shall be replaced with words "generally established retirement age";

in Item 9:

in paragraph one of part one of the word "I and II groups with" shall be replaced with words "with lung,";

third to state part in the following edition:

"In the presence of empty seats according to the decision of the relevant local executive and administrative organs special premises in special houses can be provided for rendering services of the accompanied accommodation to disabled people with the easy, moderated or expressed violation of capability to self-service having persons obliged to contain them under the law.";

the conclusion of the state center of the correctional developing training and rehabilitation about type of the house nursing home and the training program;

two photos 30 x 40 mm;

the documents confirming the status of the orphan child and child, without parental support;

the conclusion of VKK about availability at parents (parent) of the disease interfering accomplishment of parental responsibilities (in case of confiscation of children at them according to the decision of the commission on cases of minors based on the judgment without deprivation of the parent rights, deprivation of their parent rights);

the individual program of rehabilitation of the disabled person (in case of its availability).

Bodies for work, employment and social protection:

request the certificate of the residence and family composition;

request (draw up) the certificate of the size of pension, the copy of the conclusion of MREK, the decision of local executive and administrative organ on preserving for the child of premises from whom it was disposed to the house nursing home for handicapped children, the act of inspection of material living conditions of accommodation in the form established by the Ministry of Labour and Social Protection;

in case of the address of parents (or one of them if family incomplete) prepare the draft decision of local executive and administrative organ about provision of special premises in houses nursing homes for handicapped children.

explains to parents (or to one of them if family incomplete) their rights, and also the handicapped child's right to the state guarantees and types of the help;

determines need of acceptance according to the legislation of measures for protection of the rights and legitimate interests of the handicapped child for the purpose of creation of conditions for his education in family;

makes the offer to local executive and administrative organ about need of provision (refusal in provision) to the handicapped child of special premises in houses nursing homes for handicapped children.

The decision on provision of special premises in houses nursing homes for handicapped children is accepted by local executive and administrative organ in the absence of conditions for realization of the rights and legitimate interests of the handicapped child on the residence.";

in Item 20 of the word "years" about bases of ministerial procedures" (The national register of legal acts of the Republic of Belarus, 2008, No. 264, 2/1530)" shall be replaced with words "No. 433-Z "About bases of ministerial procedures";

add Item 22 with part of the following content:
