About entering of amendments and changes into the Code of penal procedure of the Republic of Armenia

Article 1. To add the code of penal procedure of the Republic of Armenia of July 1, 1998 with Article 93.1 of the following content:

"Article 93.1. Removal of the legal representative from proceeedings

1. The guardian or the custodian of the minor or incapacitated participant cannot participate in production if:

1) is in related or other relations of personal dependence with the judge, the prosecutor, the investigator or the employee of body of inquiry who participated or participates in production at the time of involvement of the legal representative;

2) is in related or other relations of personal dependence with the suspect or the person accused or their close relatives;

3) cannot be the legal representative under the law or court resolution;

4) the behavior obviously harms interests represented, the behavior interfered with implementation of the rights of represented or led to their violation;

5) is the facts about it, testimonial of making of expected crime against interests of represented.

2. The parent, the adoptive father of the minor or incapacitated participant cannot participate in production in the cases provided by Items 3-5 of part of 1 this Article.".

Article 2. To add heading of article 166 of the Code after the word of "expert" with words ", the psychologist".

Part 1 after the word "expert" to add 1) with words ", the psychologist";

Part 2 after the word of "expert" to add 2) with words ", the psychologist".

Article 3. Item 3 of part 1 of article 168 of the Code after the word of "specialist" to add with the word of "psychologist".

Article 4. In article 205.1 of the Code:

To replace 1) regarding 1 word "two" with the word "one and a half";

The word "six" to replace 2) in part 2 with the word "four".
