About modification of some regulations
The Parliament adopts this organic law.
Art. I. - Article 33 of the Trade union act No. 1129/2000 (2000, 919), with subsequent changes, to state the official monitor of the Republic of Moldova to Art. No. 130-132, in the following edition:
"Article 33. Guarantees to workers, the elected to trade-union bodies and not exempted from the main work
Workers, the elected to trade-union bodies and not exempted from the main work, use guarantees, stipulated in Clause 387 Labor codes No. 154/2003.".
Art. II. - In the Labor code of the Republic of Moldova No. 154/2003 (Official monitor of the Republic of Moldova, 2003, Art. No. 159-162, 648), with subsequent changes, to make the following changes:
1. Part (Article 29 to state 3) in the following edition:
"(3) authority punishments cannot be imposed On the employee representatives participating in collective bargainings during their maintaining, they cannot be transferred to other work or are dismissed without preliminary consultation with the trade-union bodies which authorized them.".
2. Part (Article 42-1 to add 7) with the following paragraphs:
"In all cases provided by this code when the employer hold consultations with workers/employee representatives before decision making which infringes upon the rights and interests of workers, the employer notifies trade-union body / employee representatives and requests his advisory opinion in writing.
The term of representation of opinion constitutes 10 working days from the date of receipt of the notification.
In case of non-presentation of opinion in the specified time the advisory opinion of the relevant body / employee representatives is meant.".
3. State Article 87 in the following edition:
"Article 87. The procedure of request of advisory opinion of trade-union body in case of dismissal of workers
(1) In case of dismissal of workers - members of labor union the employer requests previously advisory opinion of trade-union body of the company the notification of relevant organ.
