About provision of benefit to heirs of the health workers who died as a result of implementation of medical activities in fight against COVID-19

The Parliament adopts this organic law.

Article 1. Concept of health workers

For the purpose of this law the health workers who are directly participating in medical actions against COVID-19, doctors, medical assistants, paramedics, druggists, laboratory doctors and medical technologists, hospital attendants and drivers of pre-hospital medical care are recognized.

Article 2. Provision of entitlement to benefit

(1) the Benefit is provided if the death of the supporter came owing to infection during direct implementation of medical activities in fight against COVID-19.

(2) the Entitlement to benefit is granted:

a) to the surviving spouse for the five-year period from the date of the death of the supporter;

b) to the children who did not reach 18 years or is more senior than this age, studying at full-time departments of average, average special and higher educational institutions, before the end of study, but not longer, than before achievement of 23 years by them;

c) to one of parents - in case of absence of the heirs determined in Items a) and b).

Article 3. Calculation of benefit

(1) the Basis for calculation of benefit is constituted by the average monthly income gained and announced for the last 12 calendar months, preceding month of death. Months during which person was on vacation are replaced with the same number of the calendar months which are directly preceding settlement period.

(2) the Benefit to the surviving spouse is determined in the amount of 50 percent of basis for its calculation.

(3) the Benefit in case of children is determined in the amount of 75 percent of basis for its calculation on each heir.

(4) the Benefit in case of parents is determined in the amount of 50 percent of basis for its calculation.

(5) the Size of the estimated benefit cannot be less than 50 percent of the size of the average monthly salary on economy for date of calculation of benefit.
