About modification of some legal acts of Ukraine of rather state support of the sphere of culture, the creative industries, tourism, small and medium business in connection with action of the rationing arrangements connected with spread of koronavirusny disease of COVID-19
The Verkhovna Rada of Ukraine decides:
I. Make changes to such legal acts of Ukraine:
1. Item 14 of the Section "Final and Transitional Provisions" of the Civil code of Ukraine (2003, 356) to state sheets of the Verkhovna Rada of Ukraine to Art. No. No. 40-44, in such edition:
"14. Determine that from the moment of establishment of the quarantine entered by the Resolution of the Cabinet of Ministers of Ukraine "About prevention of distribution in the territory of Ukraine of sharp respiratory disease of COVID-19, of SARS-CoV-2 caused by coronavirus" of March 11, 2020 No. 211 (with subsequent changes and amendments), and before its cancellation (cancellation) in the procedure established by the law, the payment for use of real estate (its part) is subject to reduction upon the demand of the employer who performs business activity with use of this property, during the whole time when the property could not be used in business activity of the employer in full because of the introduced restrictions and (or) prohibition.
In the case determined by paragraph one of this Item, the amount of payment for use of property cannot exceed cumulative (in proportion to leased area) amount of expenses which the lessor made or will shall make for the corresponding period for introduction of payment for the earth, the tax discharge on the real estate other than the parcel of land, and payment of cost of utilities.
The specified expenses are assigned to the employer as payment for use of property for the corresponding period it is pro rata to the area of real estate which it hires according to the agreement if the agreement does not provide the employer's obligation independently to pay these expenses fully or partially.
